These Terms of Service (“Terms”) govern your use of the Device Scout mobile application (the “App”). The App is developed and operated by an independent developer (“we”, “us”, or “our”).

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. The App

Device Scout is an iOS utility application designed to assist users in identifying nearby Bluetooth Low Energy (BLE) devices and visualizing related information such as signal strength and approximate detection locations.

The App is provided for general informational and utility purposes only.

2. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent that you meet this requirement.

3. No Accounts or Registration

The App does not require account creation, registration, or user authentication. You are responsible for maintaining control of your device and access to the App.

4. Permissions and Device Access

To function as intended, the App may request access to certain device features or permissions, including Bluetooth and Location services.

You are responsible for granting, managing, or revoking these permissions through your device settings. Certain features of the App may not function correctly if permissions are denied or restricted.

5. Use of the App

You agree to use the App only for lawful purposes and in accordance with these Terms.

You agree not to:

• Use the App in a way that violates applicable laws or regulations
• Attempt to interfere with or disrupt the App’s functionality
• Reverse engineer, modify, or attempt to extract source code except where permitted by law
• Use the App for unauthorized tracking, surveillance, or harassment of individuals

6. Accuracy and Limitations

The App relies on Bluetooth signal data, device broadcasts, operating system services, and location information, all of which may be affected by environmental conditions, device behavior, interference, or system limitations.

We do not guarantee:

• The accuracy, completeness, or reliability of any information displayed
• That a device can be located or recovered
• That signal strength correlates precisely with distance
• Continuous or real-time operation

The App may produce false positives, false negatives, or incomplete results.

7. Device Movement and Awareness Features

The App may include features intended to highlight patterns, such as Bluetooth devices appearing across multiple locations over time.

These features:

• Are informational only
• Are not guarantees of device behavior or intent
• Are not safety, security, or tracking services

The App should not be relied upon for personal safety, threat detection, emergency response, or law enforcement purposes.

8. No Professional or Safety Advice

The App does not provide legal, security, medical, or professional advice. Any actions you take based on information provided by the App are taken at your own discretion and risk.

9. Data Handling

Information processed by the App is handled as described in the Privacy Policy, which forms part of these Terms.

Certain limited, non-identifying information may be processed by third-party service providers as described in the Privacy Policy.

Data retention and deletion depend on how the App is used, device settings, and operating system behavior, and are not guaranteed.

10. Third-Party Services

The App may rely on or integrate with third-party services, operating systems, or frameworks (such as mapping or analytics services). We do not control and are not responsible for third-party services, their availability, accuracy, or data practices.

Use of third-party services may be subject to their own terms and policies.

11. Intellectual Property

The App, including its design, functionality, text, graphics, and software, is owned by us or our licensors and is protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

12. Disclaimer of Warranties

The App is provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the App will be error-free, uninterrupted, or meet your requirements.

13. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of data, loss of devices, or loss of use, arising out of or related to your use of the App.

Our total liability for any claim arising from the App shall not exceed the amount paid by you for the App, if any.

14. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising out of your use of the App or violation of these Terms.

15. Termination

We may suspend or discontinue the App, or your access to it, at any time without notice. You may stop using the App at any time by uninstalling it.

16. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes are made constitutes acceptance of the updated Terms.

17. Governing Law

These Terms are governed by and construed in accordance with the laws of the applicable jurisdiction, without regard to conflict of law principles.
